The Frye standard, still used in some states, requires that the expert's methods be generally accepted within the relevant scientific community.
These admissibility standards mean that an expert's qualifications alone are not sufficient — their methodology must also withstand scrutiny. Attorneys should evaluate not only an expert's credentials and experience but also whether their analytical approach will survive a Daubert or Frye challenge from opposing counsel.
Consulting Experts vs. Testifying Experts
An important distinction exists between consulting experts and testifying experts. A consulting expert advises the legal team behind the scenes — reviewing documents, identifying strengths and weaknesses in the case, and helping attorneys understand technical issues. Their work product is generally protected by attorney work-product privilege and is not discoverable by the opposing side.
A testifying expert, by contrast, is disclosed to the opposing party and must produce a written report, sit for deposition, and testify at trial. Their communications with counsel, draft reports, and underlying data may be subject to discovery. Many cases begin with a consulting engagement that transitions to a testifying role if the expert's findings support the client's position.
How to Evaluate an Expert Witness
The most effective expert witnesses combine deep technical knowledge with strong communication skills. When evaluating an expert, consider their educational background and professional licenses or certifications relevant to the subject matter. Review their testimony history, including jurisdictions, case types, and whether they work for both plaintiffs and defendants. An expert who testifies exclusively for one side may face credibility challenges. Assess the clarity of their writing through sample reports, and inquire about prior Daubert or Frye challenges — an expert who has been excluded from testifying in the past requires careful vetting. Finally, ensure the expert has genuine hands-on experience in the field at issue, not merely academic familiarity.
